We at Gangar & Company offer a service to deal with the administration of the decreased Estate on your behalf. You can contact us so that we can offer you practical support and advice in order to have matters resolved as quickly as possible.
Probate is the process of the administration of the Estate and deals with assets and liabilities of the deceased Estate and Executing the Will in accordance with the instructions of the deceased. If the deceased has passed away without making a Will, then their estate will need to be distributed in accordance with the rules of intestacy.
In order for a distribution of the estate, the Executors named in the will may have to apply for a Grant of Probate or if the person who passed away had not made a will, then the next of kin may need to apply for what you call Letters of Administration.
If you are one of the persons whose name in the Will as in Executor, then you can apply for Probate.
If the person who passed away did not make a Will and you are the next of kin, then the order of priority for applying for letters of administration is in the following order: –
- Spouse
- Children (including children adopted by the person who has passed away but excluding stepchild)
- Parents
- Siblings
- Grandparents
- Uncle or Aunt
Obtaining the Grant of Probate or Letters of Administration can be a relatively complex area, but we at Gangar & Company will guide and advise you throughout the process.
Expenses & Timescales
Our estimate of cost will include advising you on what information you will need, attend to you at the office and obtain that information from you and then to submit the completed application to your local Probate Registry. We do not deal with the Administration of the Estate.
Your application to the Probate Registry will include the original Will plus two copies, the statement of truth, the inheritance tax form and the application fee.
In terms of timescales, it is difficult to predict the actual time because each application may vary however, we normally estimate that in order to obtain the grant of probate, that can take between 3 to 9 months to deal with the estate and about 3 months to obtain the letter of administration or grant of probate. The probate registry will take at least 16 weeks from receipt of the probate application to issue a sealed grant of probate.
If we are instructed to deal with the sale of any property owned by the deceased, there will be additional charges.
Please note that VAT is charged at 20%
Our costs are based on a fixed fee.
Our fees are on average are between £1,000 to £2,000 plus VAT @ 20% plus disbursements and probate fee. We will inform you of the up-to-date probate fee before the application is submitted. Disbursements are costs that are payable to third parties such the court fee.
Probate Registry fee is £300 ( no VAT ) + £1.50 ( no VAT ) per additional copy of the Grant required if the estate is over £5,000. There is no fee if the estate is £5,000 or less, obtain ownership details from the land registry is £6.00 ( no VAT ) per property.
The work involved will cover the following :-
-Identify the legally appointed Executors or Administrators and Beneficiaries
-Accurately identify the type of Probate application you will require
-Obtain the relevant documents needed to make the application
-Complete the Probate Application and the relevant HMRC forms with you
-Draft a legal oath for you to swear
-Submit the application to the Probate Court for you
-Obtain the Probate and provide two copies to you
Our legal fees in relation to Probate are dependent on the value and nature of the assets involved and whether there is a Will or not in existence.
The above costs and disbursements do not include any taxes that you may need to pay for example inheritance tax to HMRC, Building / contents insurance, valuation fees to Estate Agents, conveyancing fees if the property is transferred to a beneficiary if not sold.
Once we are aware of all the information relating to your matter, we will then be in a position to advise you with a more accurate estimate of costs, which we will keep to unless there are any unforeseen circumstances and if this happens, we will update you regarding our costs beforehand.
